Educator Facing Felony Charges After Being Caught Slapping Non-Verbal Autistic Student on Camera

In a disturbing case out of Marion, Ohio, a teacher faces felony charges for allegedly assaulting a 7-year-old special needs student. Jodi Grafmiller, an educator at Hayes Elementary School, was initially facing misdemeanor charges of child endangerment and assault; however, prosecutors in the case have since elevated the charges to a felony count of assault. The Ohio Prosecutor explained that the new charge was based on an Ohio law which provides “if an individual who is functionally impaired person is assaulted by an individual who was in the position of a caregiver, then the assault elevates to a felony.” Grafmiller has since been placed on leave while the investigation is pending.

This case serves as a stark reminder of the paramount importance of protecting our children in educational environments and the severe legal consequences for those who breach this sacred trust. This type of heinous and senseless behavior is inexcusable from our educators - especially when the victims have disabilities.
