How Does a Criminal Defense Appeal Work?
When you appeal a conviction, the goal is to present a series of facts and present evidence that attacks the order or judgment of the court on some sort of legal ground. You can appeal both your conviction and your prison sentence. Appellate courts can decide to issue a ruling based on either briefs or oral arguments. The court can decide to uphold the decision, modify the ruling, order a new trial, and can even throw out the case.
