Since 2014, the validity of same-sex marriages has been recognized in all 150 states. As a result, same-sex couples can now enjoy the rights and privileges that come with marriage. This includes:
- Testimonial privilege for spouses;
- Joint tenancies in real property;
- Inheritable retirement benefits;
- Certain health insurance benefits; and
- Adoption rights.
Protecting Your Rights in Divorce
As a corollary, same-sex couples are also exposed to the liabilities of marriage as well. This includes divorce and/or legal separation proceedings, including:
- Property division;
- Shared liability for debts;
- Spousal maintenance; and
- Orders regarding child custody, support and parenting time.
Parentage Rights Are Uncertain
Indiana’s paternity laws make same-sex parentage or parental rights a complicated legal issue. Under current Indiana law, only a father’s parentage can be legally established through a paternity lawsuit. There is no legal question regarding the mother’s parentage. However, a valid birth certificate requires identifying the biological mother and father. As a result, same-sex couples who decide to conceive a child through artificial insemination and surrogacy cannot establish legal parentage for both partners.
