Eligibility to Petition the Court Regarding Grandparent Visitation
Grandparents may seek visitation rights in one of three scenarios:
- One parent is deceased;
- The parents are going through a divorce; or
- If the child was born out of wedlock.
A grandparent has the burden to show that it is in the best interests of the child to have grandparent visitation in a court proceeding. This means filing a petition with the court for a hearing on the issue.
When evaluating the appropriateness of grandparent visitation, the court will consider:
- Any attempts to maintaining meaningful contact with the child; and
- Testimony of a child, accompanied or unaccompanied by legal counsel.
If the court interviews a minor child on the issue of grandparent visitation, the interview may remain off the official court record. However, if testimony of a child is received with counsel present, a record of the interview may be established and included with the court record for appeal purposes.
