Victims of domestic violence, stalking, or a sexual offense can request the court to order a civil protection order against their perpetrator. Protective orders are filed in a civil court; which is different from a no-contact order that is filed in a criminal court. Protective orders do not charge the respondent (the alleged abuser) with a criminal offense.

Depending on the circumstances, a protective order can be issued ex parte (meaning without a hearing or after a hearing has been held). Once the Court issues a protective order, it will generally last for two (2) years. However, after the two (2) year period expires, the court may extend the protective order if needed.

A hearing on a protective order must be scheduled/held within thirty (30) days after filing it if the order establishes/modifies parenting time, requests/modifies child support, if it prohibits/restricts a parent’s time with their children or if it effectively removes a person from their place of residence.
