What Is Vicarious Sexual Gratification?
According to Indian Code § 35-42-4-5, adults who knowingly or intentionally instruct, direct, aid, include or, cause a child under the age of sixteen to fondle themselves or another minor with intent to arouse or satisfy the sexual desires of a child or the adult can be charged with vicarious sexual gratification.
Although this offense is a Level 5 felony, it can be a Level 4 felony if a child involved in the incident is under the age of fourteen. It can also be a Level 3 felony if the accused threatened to use deadly force, had a deadly weapon, or gave the victim a drug or controlled substance without their knowledge.
Penalties for vicarious sexual gratification include:
- Level 5 Felony - Up to 1.5 years in jail.
- Level 4 Felony - Up to 4 years in jail and up to $10,000 in fines.
- Level 3 Felony - Up to 10 years in jail.
