What Qualifies Someone as a Habitual Traffic Violator?
If you are not well-versed in Indiana’s traffic law, you may be unsure whether your situation warrants HTV status. There are various ways that a driver can become labeled a habitual traffic violator.
You may be charged if you committed:
- Two major offenses involving death in a 10-year period: Certain instances of reckless homicide with a vehicle, drunk driving, or hit and runs that involve death may qualify as major offenses. This conviction leads to a 10-year license suspension or a lifetime suspension if the HTV has at least two violations of drunk driving that result in death.
- Three major offenses in 10 years: You can be charged as an HTV if you have committed three major offenses (not necessarily involving injury or death) in the span of 10 years. This conviction leads to a 10-year license suspension.
- One major offense and nine moving violations in 10 years: You could be charged as an HTV if you have committed nine traffic violations (excluding parking or equipment violations) as well as one major offense. This conviction would lead to a five-year license suspension.
