Grandparent Visitation Attorneys in Fishers

Preserving the Best Interests of Your Child or Grandchild

Indiana law recognizes the rights grandparents have to see their grandchildren. Of course, the parent’s rights to do so take priority, but there are specific scenarios where grandparent visitation rights can be established by a court order.

Our family law attorneys at Massillamany Jeter & Carson strongly advocate for grandparents, who wish to seek visitation time with their grandchildren, as we understand and appreciate the vital role grandparents play in a child’s life. However, we are also committed to helping parents oppose grandparent visitation when the circumstances do not support that a grandparent’s involvement would be in the child’s best interest.

If you are concerned about grandparent visitation, please contact us online or by phone at (317) 434-1490 to schedule a complimentary consultation with one of our Fishers grandparent visitation lawyers.

Eligibility to Petition the Court Regarding Grandparent Visitation

Grandparents may seek visitation rights in one of three scenarios:

  1. One parent is deceased;
  2. The parents are going through a divorce; or
  3. If the child was born out of wedlock.

A grandparent has the burden to show that it is in the best interests of the child to have grandparent visitation in a court proceeding. This means filing a petition with the court for a hearing on the issue.

When evaluating the appropriateness of grandparent visitation, the court will consider:

  • Any attempts to maintaining meaningful contact with the child; and
  • Testimony of a child, accompanied or unaccompanied by legal counsel.

If the court interviews a minor child on the issue of grandparent visitation, the interview may remain off the official court record. However, if testimony of a child is received with counsel present, a record of the interview may be established and included with the court record for appeal purposes.
