Fishers Child Support Lawyer

Fishers Family Lawyers & Divorce Attorneys – (317) 434-1490

In Indiana, both parents of a divorce are required to financially support their child until they reach the age of emancipation. Due to a legal change in 2012, the age of emancipation is 19. How much each parent contributes to the financial support of their children is determined by the Indiana Child Support Guidelines. (You can view the entirety of Indiana’s Child Support Guidelines can be found at http://www.in.gov/judiciary/rules/child_support/.)

Even with the Guideline in hand, it can be difficult to understand the extent of your responsibility and what a court would find agreeable. To take the guesswork out of such an important legal process, come to Massillamany Jeter & Carson and our child support lawyers in Fishers. We have the experience and insight you need to get through your child support case in a way that protects the best interests of you and your children.

How is Child Support Determined in Indiana?

The Indiana Child Support Guidelines provide a formula to determine child support obligations. Child support is generally paid by the noncustodial parent to the custodial parent, who likely encounters more situations in which they must make a payment for the child’s benefit. However, there are situations when a custodial parent may be obligated to pay a noncustodial parent child support due to the custodial parent making significantly more income than the noncustodial parent.

The factors that are used when determining the amount owed include:

  • Both parent’s gross income
  • Whether there are any subsequent or prior born children
  • Cost of weekly health insurance premiums for the children
  • Costs associated with work-related child care
  • Number of overnights the noncustodial parent spends with the children

The parties’ gross income is the factor that comes into most conflict between the two parties. Understandably, neither spouse will want to pay more than their fair share, or receive less than that amount. As such, no matter what amount you want to pay or receive, you should anticipate some resistance from your ex-spouse.
